These Terms of Service ("Terms") govern your use of the Heart Notes platform ("Service"), operated by Dioverse Technologies, Lagos, Nigeria ("we", "us", "our"). By visiting and using Heart Notes, you agree to these Terms. If you do not agree, please do not use our Service.
1. What Heart Notes Is
Heart Notes is a digital greeting card platform. It allows anyone to visit the site, select a card template, add personalised text and photos, and publish the card. After payment, the creator receives a unique shareable link to their finished card. No account registration or login is required at any stage.
2. Eligibility
You must be at least 18 years old to use Heart Notes and make a purchase. By using our Service, you confirm that you are of legal age and that any information you provide during card creation is accurate. If you are creating a card that involves a minor (e.g. a child's birthday card), you as the adult creator take full responsibility for all content submitted.
3. Card Creation
When creating a card on Heart Notes, you agree to:
- Only upload images and content that you own or have the legal right to use
- Not create cards containing false, misleading, or defamatory content about any person
- Not use the platform to impersonate another individual or organisation
- Take responsibility for the content of cards you create and share
Card content is stored temporarily on our servers for up to 12 months to allow recipients to access the shared link. After 12 months, the card and its content may be permanently deleted.
4. Payments & Refunds
4.1 Pricing
Pricing is displayed clearly on the platform before you proceed to checkout. All prices are in Nigerian Naira (NGN) unless otherwise stated. We reserve the right to change prices at any time, but changes will not affect orders already completed.
4.2 Payment Processing
All payments are handled by Paystack. By completing a purchase, you agree to Paystack's Terms of Service and Privacy Policy. We do not store or have access to your payment card details.
4.3 Refund Policy
All sales are final. Because Heart Notes delivers a digital product — your personalised card link — immediately after payment, we are unable to offer refunds once a card has been published and the link generated.
Exception: If you experience a verified technical failure that prevented your card from being created or your link from being delivered, contact us at support@myheartnotes.com within 48 hours of your purchase. We will investigate and, at our discretion, offer a replacement card creation or account credit.
5. Acceptable Use
You agree NOT to create or share cards containing content that:
- Is abusive, threatening, harassing, or designed to cause emotional harm to any person
- Contains nudity, sexually explicit material, or content that violates Nigerian law
- Infringes the copyright, trademark, or intellectual property rights of any third party
- Is fraudulent, deceptive, or intended to manipulate or deceive the recipient
- Promotes illegal activity, violence, discrimination, or hatred
- Contains malware, phishing links, or any harmful code
We reserve the right to remove any card that violates these terms, without prior notice or refund. Repeated or serious violations may result in your IP address being blocked from the platform.
6. Intellectual Property
6.1 Your Card Content
You retain full ownership of the text, photos, and personal content you upload to Heart Notes. By uploading content, you grant us a limited, non-exclusive, royalty-free licence to store, process, and display your content solely for the purpose of building and delivering your card. We will never use your personal card content for marketing, advertising, or public display.
6.2 Our Platform & Templates
All card templates, designs, platform interfaces, branding, and underlying code are the intellectual property of Dioverse Technologies. You may not copy, reproduce, resell, or redistribute any part of the Heart Notes platform or its templates without our written permission.
7. Card Link & Sharing
After payment, you will receive a unique link to your finished card. This link is yours to share with your intended recipient. You are responsible for who you share it with. We are not responsible for unauthorised sharing of links by you or by recipients.
Card links remain active for 12 months from the date of creation. After this period, the card may no longer be accessible. We recommend that recipients save or screenshot the card before the expiry date.
8. Service Availability
We aim to keep Heart Notes available at all times, but we do not guarantee uninterrupted access. The platform may be temporarily unavailable due to maintenance, server issues, or circumstances beyond our control (including third-party provider outages). We are not liable for losses arising from downtime or service interruptions.
9. Limitation of Liability
To the maximum extent permitted by applicable Nigerian law, Dioverse Technologies is not liable for:
- Any indirect, incidental, or consequential loss arising from your use of Heart Notes
- Emotional distress or reputational harm caused by card content created and shared by users
- Failures or outages of third-party providers (Paystack, Cloudinary, Render, Brevo, MongoDB)
- Loss or expiry of card links after the 12-month retention period
Our maximum liability to you for any single claim shall not exceed the amount you paid for the specific card in question.
10. Privacy
Your use of Heart Notes is also governed by our Privacy Policy, available at: https://myheartnotes.onrender.com/privacy. The Privacy Policy is incorporated into these Terms by reference. Please read it carefully.
11. Governing Law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute arising from or relating to these Terms shall first be resolved through good-faith negotiation. If unresolved after 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
12. Changes to These Terms
We may revise these Terms at any time by updating this page. Material changes will be indicated by an updated "Last Updated" date. Your continued use of Heart Notes after changes are posted means you accept the revised Terms.
